			<content:encoded><![CDATA[<p>Controversy is roiling the waters of San Francisco&#8217;s public harbor, as city officials move to impose new rules governing use of the prime boat slips fronting the Marina Green.<span id="more-642"></span></p>
<p>Gone would be the tenants&#8217; longtime practice of subleasing their berths and if they leave for good, selling their boats and transferring the slips with them to the highest bidder or people they know. City officials believe some buyers have been more interested in getting a berth instead of a boat.</p>
<p>&#8220;We don&#8217;t think people should be profiteering off a public asset,&#8221; said Phil Ginsburg, general manager of the city&#8217;s Recreation and Park Department, which operates the harbor.</p>
<p>But to many longtime boaters there, the proposed rules are unreasonable and need to be stopped.</p>
<p>&#8220;They have been making their concerns known,&#8221; said Supervisor Mark Farrell, who represents the city&#8217;s north-side Marina district, where the harbor is located. He will convene a meeting this week with Recreation and Park Department officials and leaders with the San Francisco Marina Harbor Association, a representative of harbor tenants.</p>
<p>Some of the proposed rules &#8211; among them requiring people who use the facility to be properly attired, a demand that boaters must alert the harbormaster when their vessels will be out of the harbor for 24 hours or more, and a requirement that children under 18, including practiced junior sailors, have adult supervision &#8211; are &#8220;obtrusive and completely silly regulations that are impractical and/or unenforceable,&#8221; said Bruce Stone, who heads the association.</p>
<p>But the plans for sublets and transfers have raised the most ire, which shouldn&#8217;t be surprising given the potential financial consequences for the people who berth their boats at the marina.</p>
<p>&#8220;When we came into the harbor, we were told that we could transfer our berths to someone who purchases our boat. I believe the city and harbor management will be going back on its word to us if this right is taken away. It may also be illegal since it will have a negative effect on our ability to sell our boats,&#8221; Bruce Munro, an attorney and vice president of the Marina Harbor Association, wrote in a recent e-mail to Ginsburg and others on his staff.</p>
<p>&#8220;Any purchaser of a boat naturally needs a place to keep it,&#8221; added Munro, a tenant in the San Francisco Marina for more than three decades.</p>
<p>Stone said that the boaters aren&#8217;t looking to make a profit but to recoup the investment they made when they took over a slip through the transfer process, and in physical improvements they may have made to their slips and the dock.</p>

			<content:encoded><![CDATA[<p>The San Francisco Giants are eager to have Buster Posey back behind the plate this season &#8211; and stay there. Posey tore three ligaments in his left ankle and broke a bone in his lower leg in a home-plate collision with the Marlins&#8217; Scott Cousins last May, costing the 2010 NL Rookie of the Year the entire 2011 season.<span id="more-640"></span>Posey was in camp with the team in Scottsdale, Arizona on Sunday but won&#8217;t be catching just yet. He will take part in other baseball activities until manager Bruce Bochy decides he&#8217;s ready.</p>
<p>Bochy plans to take a conservative approach with his catcher going forward, including not having Posey block the plate when a player is trying to score.</p>
<p>&#8220;I&#8217;ll take this out of Buster&#8217;s hands,&#8221; Bochy told reporters Sunday. &#8220;As a manager, that&#8217;s my job. I certainly don&#8217;t want people to think he&#8217;s backing off on his own. It&#8217;s something we&#8217;ll work on with him this spring.&#8221;</p>
<p>Bochy, a former catcher himself, wants Posey to be &#8220;defensive&#8221; about his body while still attempting to tag out runners at home plate.</p>
<p>&#8220;I&#8217;ve already talked to Buster about this. There are ways to make the tag without putting yourself in jeopardy,&#8221; Bochy said, according to USA Today. &#8220;I don&#8217;t want him to block the plate right now.&#8221;</p>
<p>Bochy indicated it&#8217;s possible Posey could play in the Giants Cactus League opener on March 3 vs. the defending NL West champion Arizona Diamondbacks.</p>
<p>In 2010, Posey batted .305 with 18 home runs and 67 RBI in 108 games and said his swing is already returning to form.</p>

			<content:encoded><![CDATA[<p>San Francisco hedge fund manager Christopher Hansen is making a $290 million proposal to his hometown that could be the impetus for a new sports arena that could bring the NBA and NHL to Seattle.<span id="more-637"></span></p>
<p>All he needs is city and county approval and two franchises to make it a reality.</p>
<p>Hansen submitted a proposal to the city Thursday that calls for $290 million in private investment, plus the cost of acquiring an NBA franchise, to help construct a facility that would cost between $450 million and $500 million.</p>
<p>According to a letter submitted by Hansen to the city, the remaining construction and development costs would be financed by the city and King County using taxes and revenues generated by the new facility and rent charged to the teams playing in the arena. City officials are adamant that there will be no new public taxes needed for the building. The city and county&#8217;s debt service for the arena would be capped at $200 million.</p>
<p>The entire project is contingent on Hansen and his investors finding a franchise to make Seattle its home for the long haul. Language in the proposal would call for a 30-year lease with a no-relocation clause.</p>

			<content:encoded><![CDATA[<p>More than 80 percent of residential mortgage loans that have gone into foreclosure in San Francisco have missing documents or signatures or otherwise violate the law, according to a review ordered by the city assessor.<span id="more-635"></span></p>
<p>While many of the errors were technical and related to paperwork, the problem shows the state needs to change its antiquated real estate regulations, Assessor-Recorder Phil Ting said on Wednesday.</p>
<p>&#8220;The whole process &#8230; is absolutely, 100 percent broken and not working for any of us at this time,&#8221; Ting said. &#8220;These rules were made for people who walked or rode their horse to the bank.&#8221;</p>
<p>The review found that signatures of some original owners of loans were missing and that affidavits were not filed showing lenders had contacted borrowers to discuss their options 30 days before a mortgage default notice.</p>
<p>The review was conducted by Newport Beach-based Aequitas Compliance Solutions. The company looked at 382 of the city&#8217;s 2,405 foreclosure sales between January 2009 and October 2011.</p>
<p>The report said it was possible that homeowners were accused of defaulting on loans that they had never agreed to in the first place, and were being foreclosed by lenders that didn&#8217;t own the loans.</p>
<p>&#8220;How can we expect homeowners to have a fighting chance of saving their homes when they can&#8217;t even find who currently owns their debt?&#8221; Ting said in a statement.</p>
<p>The report was not aimed at individual lenders, but the system in general. It suggests similar problems could be found elsewhere in the state, Ting said.</p>
<p>He said it would be up to the District Attorney&#8217;s Office and state Attorney General&#8217;s Office to determine whether the violations were prosecutable.</p>

			<content:encoded><![CDATA[<p>In a blistering criticism of federal oversight of natural gas pipelines — including the San Bruno line that ruptured in 2010, killing eight people and leveling an entire neighborhood — San Francisco Tuesday sued the nation’s top regulator.<span id="more-633"></span>City Attorney Dennis Herrera’s federal lawsuit alleges that the U.S. Pipeline and Hazardous Materials Safety Administration failed to enforce federal pipeline standards both before and after the San Bruno disaster, even in the face of large-scale state and federal investigations.</p>
<p>“One of the most troubling findings to emerge in the 18 months since the San Bruno tragedy is that regulators were either asleep at the switch or far too cozy with the industry they’re supposed to regulate,” Herrera said in a statement Tuesday.</p>
<p>In addition to the San Bruno pipeline, Pacific Gas &amp; Electric Co. operates two other major local gas transmission lines, Herrera said, one of which runs beneath “densely populated residential areas and business districts in San Francisco where hundreds of thousands live and work.” Failure of these lines could also threaten schools, recreations centers and San Francisco General Hospital, as well as stretches of highways 101 and 280, he said.</p>
<p>The pipeline administration declined comment on the suit. Spokeswoman Jeannie Layson said the agency is committed to its duties.</p>
<p>“We will keep working with state and local officials and communities, including San Francisco, who share a common responsibility to improve pipeline safety,” Layson said.</p>
<p>Herrera didn’t sue the California Public Utilities Commission, pointedly withholding judgment on the agency that actually oversees PG&amp;E because of its recent efforts to improve its enforcement practices.</p>
<p>Under the federal Pipeline Safety Act, state pipeline regulators can assume responsibility for enforcing pipeline safety as long as there is federal oversight. But Herrera’s suit said the federal agency has shirked that duty for more than a decade, letting PG&amp;E regulate itself.</p>
<p>“Self-regulation has allowed PG&amp;E, with the apparent blessing of PHMSA and the CPUC, to pervasively and continuously violate federal pipeline safety standards in order to maximize profits at the expense of safety,” the suit said.</p>

<p>San Francisco Mayor Ed Lee apparently couldn&#8217;t agree more. He&#8217;s planned a special tribute to the song (along with its original Tony Bennett recording, now 50 years old) for today&#8217;s holiday. Festivities will include playing the tune over the loudspeakers at City Hall.</p>
<p>But loudspeakers alone aren’t enough for Lee. He’s made a request to all of the radio stations in town to do the same and play Bennett’s song today at noon.</p>
<p>KOIT, the city’s “lite rock, less talk” station, is planning to play the song, according to the mayor’s office. <em>Radio Survivor</em> reports that public/community radio station KALW will also play along, as will classical KDFC, and a number of local online-only stations.</p>
<p>But what about stations where crooners like Tony Bennett are a foreign concept, such as hip hop and R&amp;B station 106 KMEL or classic rock station 107.7 The Bone? Does Mayor Lee carry enough political weight to make professional radio stations abandon their formats entirely in the middle of prime lunchtime listening? We reached out to several S.F. stations we thought might be least likely to already have Bennett in their rotations, but haven&#8217;t heard back from any of them. Guess we’ll just have find out if they’re playing along the old fashioned way: by tuning in.</p>

			<content:encoded><![CDATA[<p>The San Francisco Police Department has become the nation&#8217;s first law enforcement agency to assure lesbian, gay, bisexual and transsexual young people that yes, it does get better.<span id="more-628"></span></p>
<p>More than a dozen LGBT officers and dispatchers appeared in the 8 1/2-minute video released Friday on YouTube and the department&#8217;s website. It&#8217;s part of a nationwide effort by the nonprofit Trevor Project to deal with the rising number of teen suicides in the gay community.</p>
<p>The uniformed officers spoke directly to the camera, talking about their younger years, the problem they had living lives in the closet, and the complete relief it was to come out and be honest with their parents and the people around them.</p>
<p>&#8220;I was a police officer for four years and believed I was the only gay male police officer in the world,&#8221; one officer said.</p>
<p>Others talked about how their lives changed when they came out to others.</p>
<p>&#8220;I think it was harder for me to tell my mom than it was for my mom to hear what I had to say,&#8221; a female officer said.</p>
<p>The video, which took about five months to produce, was done for free by San Francisco filmmaker Shawn Northcutt and local musician Lynden Bair, said Cmdr. Lea Militello, who helped put together the project.</p>
<p>It wasn&#8217;t hard getting the cooperation of the department and its 200 openly LGBT officers.</p>
<p>&#8220;We put out the word and had plenty of volunteers,&#8221; Militello said. &#8220;We wanted to show all ages, all ranks, all genders, all ethnicities, all assignments.&#8221;</p>
<p>Police Chief Greg Suhr said it was &#8220;a no-brainer&#8221; to have the department participate in the same &#8220;It Gets Better&#8221; message of hope that the San Francisco Giants already have.</p>
<p>In the video, Suhr talks about getting bullied as a young kid.</p>
<p>&#8220;I can&#8217;t even imagine what it&#8217;s like to grow up as an LGBT youth today, and no one deserves to get taunted or bullied,&#8221; he said. &#8220;It does get better, and until it does, we here in the San Francisco Police Department are going to stick up for you.&#8221;</p>
<p>Besides being available online, the video will be distributed to the San Francisco Unified School District and other interested groups. Militello also expects to hear from other law enforcement groups interested in similar projects.</p>
<p>&#8220;We wanted to keep this under wraps while it was being prepared, but now it&#8217;s out there and we hope everyone sees it,&#8221; she said.</p>

Lee today announced plans for a Citywide civic celebration to honor the acclaimed, award winning singer Tony Bennett whose signature song “I Left My Heart in San Francisco” was recorded 50 years ago. The free public tribute with Tony Bennett will take place on Valentine’s Day, Tuesday, February 14, 2012, at noon in the City Hall Rotunda.</p>
<p>“Thanks to Tony Bennett, people have been experiencing the magic of San Francisco for 50 years no matter where they are in the world,” said Mayor Lee. “The song reminds us of why we love our City so much and when we are away, it calls us home. Mr. Bennett’s signature voice is celebrated around the world, and when he comes back to San Francisco, our hearts will surely be lifted.” </p>
